Hillary and “The Server Scandal”

“Lock Her Up” was the cry from the crowd to Donald J Trump at his rallies in the lead up to the 2016 Presidential election. Few European news consumers will have been provided with the context to these chants, nor the message. During the 2^nd Presidential debate, Hillary Clinton made a barbed verbal assault on Donald Trump, to which Trump, in his alpha-male style, responded without hesitation and to memorable effect.

HRC: “…it’s just awfully good that someone with the temperament of Donald Trump is not in charge of the law in our country.”

DJT “Because you’d be in jail.”

So what is the context?

The extent of criminality in which Hillary Clinton has been engaged may or may not be fully detailed and subject to scrutiny in a US court of law. I hope, for the sake of Americans, their country and its future that it will. There are many subjects of interest and it isn’t easy to know where one should begin, and there are several ongoing investigations by the Department of Justice (DoJ) and the Federal Bureau of Investigation (FBI) so I will plump as a first subject for what I shall refer to as “The Server Scandal”.

Currently the Department of Justice is investigating, and has been for some time, the matter of the lawfulness of Hillary Clinton’s methods of communication whilst Secretary of State in the Obama Administration. On the 6^th of November 2016 the BBC Reported that “…Hillary Clinton has been cleared for a second time by the FBI over her use of a private email server while secretary of state. What’s it all about…” What follows from the BBC correspondent Anthony Zurcher is not untypical of the severely partial approach that the BBC takes to its political ‘reporting’. A view through just the headlines of his articles betrays a continual critique on the character of Donald J Trump, but little on the plethora of scandals surrounding both Hillary Clinton and her husband, President Bill Clinton. Zurcher likes to frame his articles with a question, a classic propagandist technique for “setting the narrative” which is made more effective when coordinated with other major news providers. So two days before the US Presidential election, news broadcasters were setting the narrative in the case of “The Server Scandal” suggesting that Hillary Clinton had been ‘cleared’. In his report Anthony includes much basic background on the case and the following:

“Sceptics have countered that the real reason Mrs Clinton established her own email system was because it gave her total control over her correspondence. With her email setup, she became the sole arbiter of what should and shouldn’t be provided to the government, made public via freedom of information requests or turned over to interested parties, such as the congressional committee investigating the 2012 attack on the US consulate in Benghazi.”

The ‘sceptics’ of course had, and have, a point. A point about which Anthony’s natural tendencies towards questioning, absent themselves. Over a year later and the matter is not going away.

The British consumers of news via the BBC have not been well served in this matter, for the issue was always a matter of law – and the law at issue was nakedly and publicly broken. The announcement made on the 6^th of November by James Comey, the then Director of the FBI was the second time he had personally exonerated Hillary Clinton. Many of the facts are easily available  and not contentious:

• Hillary Clinton set up her own private email account.
• In her role as Secretary of State, Hillary Clinton is obliged by law to ensure all communications are protected by strictly following mandatory protocol.
• In undertaking duties in government, using servers and email addresses other than those dictated by protocol, is a crime punishable by imprisonment.
• Hillary Clinton’s private server was subject to a security breach.
• Approximately 33,000 emails from the server were made public via Wikileaks.
• An investigation by the FBI into whether Hillary Clinton broke the Law commenced.
• The FBI subpoenaed the contents of Hillary Clinton’s private server and her telephones.
• Hillary Clinton’s private server and telephone devices which were the subject of the subpoena were destroyed with hammers and the server hard drive was ‘bleach-washed’ – which I believe to be techno-spiel for the permanently irrecoverable removal of data.
• Destroying evidence that is the subject of a subpoena is a crime.
• The investigation determined that classified information had been sent and received through Hillary Clinton’s private server. This is a crime.

The public record shows that Hillary Clinton broke the law in relation to her communication of government information, including classified information, out with confines of mandatory protocol and outside the requirements of the Law. Despite this clear evidence, James Comey as Director of the FBI ‘exonerated’ Hillary Clinton initially on the 5^th of July 2016 (four months before the election) saying:

 “Although there is evidence of potential violations of the statutes regarding the handling of classified information, our judgment is that no reasonable prosecutor would bring such a case.”

Previously, the incumbent head of the Department of Justice, Attorney General Loretta Lynch had advised what course of action would follow: “The F.B.I. is investigating whether Mrs. Clinton, her aides or anyone else broke the law by setting up a private email server for her to use as secretary of state” she is quoted as saying. But “the case will be resolved by the same team that has been working on it from the beginning” and “I will be accepting their recommendations.”  Lynch told reporters this after refusing to recuse herself in the investigation following calls for her to do so after reports of her clandestine “tarmac” meeting with President Bill Clinton at Phoenix Sky Harbour International Airport in late June 2016 were broadcast.

The scales of justice are not level and the lady’s blindfold has slipped from her eyes.  Who watches the watchmen when it is mutual friends filling all positions in the network of structures comprising the ‘checks and balances’ required by the US Constitution.

The reason that the emperor has no clothes is that the information is now public. That the information is now public demonstrates why the law is there. That the contents of the publicly available information demonstrate that Hillary Clinton has broken the Law shows that the emperor has no clothes. James Comey, Hillary Clinton, Bill Clinton, Loretta Lynch are the emperors, proud of their attire, humoured by compliant ‘journalists’ like Anthony Zurcher who play along with the fantasy and refusing to report the bare, naked truth. The swamp of which Donald Trump spoke and of whom many more are today speaking, is the swamp of emperors in Washington DC and it is this that Trump voters were wanting him to ‘drain’.

“What’s it all about?” Anthony Zurcher carelessly and incuriously queried. To those who care, what it is about is crystal clear. To the families of Glen Doherty, Sean Smith, Tyrone Woods and Ambassador Chris Stevens what it’s all about is obvious. To all conscientious Americans betrayed, insulted and wounded by Hillary Clinton and who have analysed her actions this is a matter of transparency, truth, justice and honour – of principles, foundational principles. They are rightly asking whether we are all equal under the Law, or whether the emperors are more equal than others.  Is the Law now demonstrably corrupted – an elitist and untouchable oligarchy being above it? Will America heal this open wound in its history and Constitution and allow due process to openly and honestly be seen to be done? “Lock Her Up” was the cry, “Drain the Swamp” the refrain – not declarations of deplorables, fascists, racists or revolutionaries, but of those who know right from wrong, lawful from criminal and feared the election of Hillary Clinton who  ’should be in jail’.  Loretta Lynch is no longer Attorney General and James Comey is no longer Director of the FBI. Whether those in the Trump administration team are protecting the old emperors’ fantasy or whether they are angered at the public naked display is yet to be fully revealed.

Glen Doherty, Sean Smith, Tyrone Woods and Ambassador Chris Stevens were serving the US Government in the US embassy in Benghazi in 2012. Information relating to the actions of the Secretary of State Hillary Clinton around the time of their murders on 11^th of September 2012 was made available to the public as a result of her illegal use of her private server and the consequential loss and publication of classified information.  From a human level, the revelations can engender nothing less than disgust in the actions of an inhuman woman – Hillary Clinton – as reflected in this recorded statement from Patricia Smith the mother of Sean Smith.
